A proposed settlement has been reached in a lawsuit entitled McKenzie et al. v. Allconnect, Inc., No. 5:18-cv-00359-JMH (“Lawsuit”), pending in the United States District Court for the Eastern District of Kentucky. The Lawsuit alleges that on or about February 14, 2018, Allconnect was the victim of a phishing attack resulting in the disclosure of 2017 W-2 Tax Forms of individuals who work for or had worked for Allconnect (the “Data Breach”). Allconnect maintains that it had meritorious defenses, and it was prepared to vigorously defend the lawsuit. The settlement is not an admission of wrongdoing or an indication that Allconnect has violated any laws, but rather the resolution of disputed claims. Allconnect encourages all persons who qualify as members of the Settlement Class to participate in the Settlement.
Who Is Included?
Allconnect’s records indicate you are included in the Settlement as a Settlement Class Member because you are a current or former Allconnect employee whose 2017 W-2 Tax Form was involved in the Data Breach.
What Benefits are Included in the Settlement?
- Each Settlement Class Member will receive a direct payment check of $100.
- Settlement Class Members that enrolled in the AllClear ID Original Offering after the Data Breach will have their plan automatically extended for an additional five years to April 6, 2025. All Settlement Class Members who have not previously signed-up for the AllClear ID Original Offering are still able to do so without affecting their rights under the Settlement Agreement. The deadline for enrolling in the AllClear ID Original Offering is April 6, 2020.
- All other Settlement Class Members shall have the option to sign-up for the AllClear ID Settlement Offering of an additional five-year period of coverage to April 6, 2025.
- Any Settlement Class Member may submit one or more Claims for reimbursement for documented Economic Losses related to the Data Breach that have not been reimbursed by AllClear ID or other third parties, up to an aggregate total of $4,000.00 per Settlement Class Member and $500,000 for all Settlement Class Members, provided, however, that no Settlement Class Member may submit a Reimbursement Form unless said Settlement Class Member has first submitted a Reimbursement Claim to AllClear ID, AllClear ID has denied the claim, and said Settlement Class Member has exhausted AllClear ID’s claims process.
How Do I Receive Settlement Benefits?
To receive the AllClear ID Settlement Offering, Settlement Class Members must submit an Election Form to the Settlement Administrator by October 17, 2019. To file a claim for reimbursement of Economic Losses Settlement Class Members must submit a Reimbursement Form to the Settlement Administrator by the later of, October 28, 2021 or 2 years from the Settlement Effective Date. Both forms are available at www.ALLCONNECTSETTLEMENT.com, by emailing Info@AllconnectSettlement.com, or by writing to the Settlement Administrator at ALLCONNECT SETTLEMENT c/o Settlement Administrator, 1500 John F Kennedy Blvd. C31, P.O. Box 58186, Philadelphia, PA 19102. Both forms may be submitted through the Settlement Website or by mail to the Settlement Administrator.
What Are My Options?
You can do nothing, submit an Election Form or a Reimbursement Form, or exclude yourself from the Settlement. If you do nothing or submit an Election or Reimbursement Form, your rights will be affected. You will not be able to sue Allconnect in a future lawsuit about the claims addressed in the Settlement. If you exclude yourself, you will not receive the listed Settlement benefits—but you will keep your right to sue Allconnect in a separate lawsuit on the issues covered by the Settlement. You must contact the Settlement Administrator by mail to exclude yourself. If you do not exclude yourself, you can object to the Settlement, Class Counsel’s request for fees and expenses, or the Settlement Class Representatives’ requests for service awards. All Requests for Exclusion and Objections must be postmarked or filed in person by August 18, 2019.

The Final Approval Hearing. The Court will hold a Final Approval Hearing at 1:30 P.M., on, October 28, 2019, at the United States Courthouse. 101 Barr Street, Lexington, KY 40507. At the Final Approval Hearing, the Court will consider whether the proposed settlement is fair, reasonable, and adequate. The Court may also consider Settlement Class Counsel’s request for attorneys’ fees and costs of up to $550,000, and service awards of $3,500 to each of the two Settlement Class Representatives that filed this Lawsuit. If there are objections, the Court will consider them.
